HB 1549The Help America Vote Act (HAVA) was signed into law by the president on October 29, 2002. It creates many mandates for state and local governments. Provisional Ballots replace the Challenged Ballot System. Basically, anyone who is neither on the poll list nor has sufficient identification has to vote provisionally. Challenged ballots were counted at the official counting of ballots, but provisional ballots are not counted until after the Judge and Voter Registrar have determined the validity of the voter registration. The Voter Registrar has until the third working day after the election to respond. Then the Early Ballot Board reconvenes to count the provisional ballots and add them to the final count of all the ballots. The City Council can then canvas the election. The Early Voting Ballot Board Judge has ten working days after the election to notify the voter if his/her ballot was rejected or accepted.
